Yup the current rpm is lower as the requested in the software but if I measure the headspeed it's a lot higher then the software says

Did you double check your gear ratio settings? A discrepancy between the values you see in the Spirit software and what you see in an RPM meter could depend on that....

The problem can happen, when response of the motor is very slow.
Thus you can improve it with increasing Throttle Frequency.
You can also try to set Very slow spoolup rate.

I have the frequency on 333 so that's a problem spool up is possible I have it now on fast gear ratio is correct and motor poles also

Please describe what type of sensor, what helicopter and motor you are using.
Can you check if the readings of the sensor are stable so you can see in the Current RPM that it holds within range of units?

Is your collective pitch at the center position when you are testing this?
If not, than this is very normal behavior, because governor has active feed forward feature. This is determined by the value of Governor Response parameter which you want to use in the flight.
After update from 1.2 you have to re-do governor settings, else it will not work properly with the same values.
Testing governor at the bench is meaningless in this sense.

I'm using the lynx eox 4100kv motor the hobhywing 40a platinum esc and the hobbywing rpm sensor to I have tried 3 different rpm sensors no difference and before the update the first one was working fine

And why midstick my rpm must be 2400 if I ask not 3950 al the time ?

By the way your settings of motor poles is very wrong for your motor. In this way it can't work properly.

It is very sad you are swearing on multiple forums while even the basic settings is not correct.
Your sensing divider should be configured to 3, not 6.
