Nitro gov does not hold RPM

May need some help trying to get my GOV in my Spirit GT to work properly.
I have a Synergy N5C that had a nice working Futaba CGY750 (awesome gov BTW) but can't seem to get the Spirit gov to work properly.
if anyone has any tips to give me before I switch back to the CGY750, would be much appreciated.
here is a quick run down on the steps performed
1/ calibrated throttle in the radio with software 0-100%
2/ setup gov info in software, throttle range, sensor (I have one active and one non active magnet on my clutch bell) sensor shows active throughout full rotation of clutch bell and then when it senses the other magnet it goes out quickly, not sure if this is how it should read (sensor is the Xguard RC one)
3/set proper gear ratio (8.5 to 1 on the N5C)
4/ Flat throttle curves register the proper target RPM I want (1800,1900,2050)
5/ maximum head speed is set at 2400rpm and this is where my problem is.
when I flick out of TH the RPM's shoot to 2400, I have no different head speeds between my normal, idle1, idle2.
Log viewer first showed a noisy sensor so I adjusted filter value to 7 and that seem to fix it because the next log showed governor engaged but still couldn't get rpm to register.
this is getting frustrating due to the fact that I have been working on this for the past month and the same thing happens over and over, start - walk out to flight line- flick out of TH - RPM shoots to MAX. - shut down motor.
I have tried different sensors, switched out throttle servo, double checked my wiring (sensor getting 3.3 volts from the SAT1)
Not sure what to do try next.
software is still at 3.3.1 because my android phone is still at the same version until it gets updated I will not change the unit.
